Student Non-Academic Appeals Procedure

  1. Purpose
    1. The purpose of this procedure is to outline the process to appeal a decision of suspension or dismissal under the Student Community Standards (SCS) Policy or dismissal under Mandated Supported Leave (MSL) Policy.

Term Definitions
Appellant A student who starts a process to have a SCS or MSL outcome decision around suspension or dismissal appealed based on 1 or more identified grounds.
Grounds The reasons used to challenge a non-academic decision and/or launch an appeal. Acceptable grounds for appeal are outlined in section 3.1

  1. Grounds for Appeal
    1. A student may proceed to a formal appeal only if grounds can be established under one or more of the following: 
      1. A procedural error was committed by the original decision maker.
      2.  Documentation or evidence supplied by the student shows that the original decision is not accurate or not reasonable.
      3. New evidence is available that, through no fault of the student, was not available at the time of the original decision.
      4. The outcome is unduly harsh given the circumstances.
  2. Student Non-Academic Appeals Committee Structure 
    1. The Student Non-Academic Appeals Committee includes:
      1. AVP, Student Affairs or designate (Chair)
      2. Principal or designate
      3. Student Services Staff member (Cultural Support/Counsellor/Student Accessibility)
    2. The committee must not include any member from the campus where the SCS/MSL outcome was assigned. A roster of potential committee members who will serve for 2 years will be kept with the Office of the AVP, Student Affairs.
Process

1. Complete the Student Non-Academic Appeal Request Form and submit to . If assistance is required a Student Services staff member can support the Appellant. If the Appellant has been dismissed from the College and no longer has access to Connect, the Manager of Student Services will provide a copy of the form. Appellant within 10 business days following the outcome letter for the decision being appealed. Late submissions will not be accepted.
2. Acknowledge receipt of appeal request form. Auto-reply via email
3. Review appeal submission and determine if grounds for appeal have been met. Chair, Student Non-Academic Appeals Committee
4. The Appellant will be notified by the Chair/designate if grounds have been met, and an appeal will be heard or, if grounds have not been met, an appeal will not be heard. This decision is final. Chair, Student Non-Academic Appeals Committee within 5 days of receiving submission

If appeal is to be heard:

5. The Student Non-Academic Appeals Committee will arrange to meet with the Appellant at an agreed upon time either in person/or on video to hear their reasons for appeal, proposed remedy, and any other relevant information.

This meeting will not be recorded, and notes will be kept by a Recording Secretary for the Chair.

The Appellant will be invited to bring a support person, as defined in the SCS policy, to this meeting should they choose and must give this individual's name to the Chair before the meeting. Accommodations or cultural support can be arranged.

If the Appellant fails to attend the meeting, the appeal will be dismissed and not reheard unless specific reasons for failing to attend were given to the Chair in advance of the meeting

6. The Student Non-Academic Appeals Committee may meet separately with the Manager, Student Services (MSS), Student Community Standards Consultant, and others involved in the policy outcome decision to obtain more information as needed. Student Non-Academic Appeals Committee
Decisions

7. The Chair of the Student Non-Academic Appeals Committee will notify the Appellant in writing of the decision of the Committee. 

The decision will be one of the following:

  1. Appeal denied – outcomes are held and considered final
  2. Appeal accepted
  3. Adjustment - outcomes are altered

The decision of the Student Non-Academic Appeals Committee is final and binding

  1. Records Management
    1. Files related to appeals will be held with the Office of the AVP, Student Affairs and retained based on College policies.
